1. About These Terms

These Terms and Conditions ("Terms") set out the basis on which Eldermark provides access to its website at eldermarkad.pro and delivers its document organisation and information sessions. By visiting our website or booking a session, you confirm that you have read and accept these Terms.

2. Nature of Our Services

Eldermark provides document organisation and information services for individuals approaching or in retirement. All sessions are educational and administrative in scope. In particular:

Our three current session formats are the Personal Records Briefing, the Records Pairing Session, and the Records Reorganisation Programme. Details of each are available on our website.


3. Booking and Confirmation

A session booking is made when Eldermark confirms your booking in writing by email. Submitting a contact or enquiry form does not constitute a confirmed booking.

Eldermark reserves the right to decline a booking request at its discretion, in which case any payment received will be returned in full.

You are responsible for ensuring that the contact details you provide are accurate and current. Eldermark will communicate session details, including time, venue or format, and any preparation materials, to the email address you provide.


4. Fees and Payment

Current session fees are displayed on our website in Malaysian Ringgit (RM). Fees are:

Payment terms and accepted methods will be communicated at the time of booking confirmation. Eldermark reserves the right to amend fees for future bookings with reasonable notice. Fees already paid for confirmed sessions are not affected by any such change.


5. Cancellation and Rescheduling

5.1 Cancellation by Participant

If you need to cancel a confirmed session, please notify us as early as possible by email or telephone. The following terms apply:

5.2 Cancellation by Eldermark

Eldermark may cancel or reschedule a session due to unforeseen circumstances, including facilitator unavailability or circumstances beyond our reasonable control. In such cases, participants will be given the option of a rescheduled session or a full refund. We will provide as much advance notice as possible.


6. Participant Conduct and Responsibilities

Participants are asked to arrive or connect punctually and to engage respectfully with the facilitator and, where applicable, other participants. Sessions are held in a considered atmosphere, and Eldermark reserves the right to end a session early if participant conduct is disruptive or distressing to others.

Participants are solely responsible for any documents or records they bring to a session. Eldermark does not retain, copy, or store any personal documents presented during a session.

For the Records Pairing Session, both participants confirm by attending that they have consented to share reference information with each other during the session.


7. Intellectual Property

All materials produced or distributed by Eldermark during sessions — including printed briefing sheets, reference summaries, folder labels, and handbooks — are provided for the personal use of the participant(s) who attended that session.

These materials may not be reproduced, resold, or redistributed without the written permission of Eldermark. All content on the Eldermark website, including text, structure, and design, is the property of Eldermark and is protected under applicable Malaysian intellectual property law.


8. Limitation of Liability

Eldermark's sessions are informational and organisational only. Eldermark does not accept responsibility for any decision made by a participant based on the general information presented in a session. Participants are responsible for verifying the accuracy and completeness of their own records and for seeking appropriate professional guidance for their specific circumstances.

To the extent permitted by law, Eldermark's total liability for any claim arising from a session or use of the website shall not exceed the fee paid by the participant for the session in question.

Nothing in these Terms limits liability for fraud, wilful misconduct, or any matter that cannot lawfully be excluded.


9. Website Use

You may use the Eldermark website for lawful personal purposes. You agree not to attempt to disrupt, copy, or interfere with the website or its content, and not to use the website in a way that may harm Eldermark or any third party.

Our website may contain links to third-party websites for reference. These links are provided as a convenience and Eldermark is not responsible for the content or practices of those sites.


10. Privacy

The handling of personal data in connection with your use of our website and participation in sessions is governed by our Privacy Policy. By using the website or booking a session, you acknowledge that you have read the Privacy Policy.


11. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or from the provision of our services shall be subject to the jurisdiction of the courts of Malaysia.


12. Changes to These Terms

Eldermark may update these Terms from time to time. The version published on our website represents the current Terms. Continued use of the website or participation in sessions after any update constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
